Industry bodies have urged the Telecom Regulatory Authority of India (TRAI) to exempt online gaming from the scope of the proposed National Broadcasting Policy, 2024 (NBP). Industry association AIGF suggested that the implementation of AVGC recommendations in mission mode would be the ideal strategy for harnessing the potential of the sector’s continued growth and innovation.

FICCI also emphasised that finalizing and promptly notifying the national AVGC policy is crucial, alongside establishing dedicated oversight and coordination mechanisms between state and central governments to foster comprehensive development and regulation of online gaming. Similarly, Assocham and Broadcast India Forum urged that the pressing need now is to bring IT Rules 2021 into full operation to ensure responsible growth of the industry while safeguarding consumer interests.

While stressing on need to implement the AVGC Policy, IAMAI suggested a regulatory framework similar to the regulatory framework for Over-The-Top (OTT) platforms introduced in Part III of the IT Rules 2021. IAMAI also suggested the introduction of a registration mechanism for all online gaming intermediaries with MeitY which could ensure that only legitimate platforms operate within India. Law firm Cyril Amarchand Mangaldas also highlighted the need for regulation of the online gaming space through IT Rules 2021 or other appropriate measures by MeitY.

Industry body FIFS said the IT Rules 2021 have been drafted following extensive stakeholder consultations, and incorporate principles aimed at fostering an open, safe, transparent, and accountable online gaming environment and the MeiTY is best positioned to effectively govern, administer, and regulate the online gaming industry in India through the said Rules. FIFS urged TRAI to avoid regulatory overlap with IT Rules 2021 and the National Broadcasting Policy 2024.

Policy think tank The Dialogue urged the need for harmonisation and upholding distinct regulatory frameworks that cater to the specific needs and challenges of different communication services. The consultation paper was released on 2 April 2024 with 30 April 2024 as the last date for comments from stakeholders.
