Creativeland Asia Files Case Against WinZO Over Alleged Misuse of Creative Idea

Creativeland Advertising Private Limited has filed a petition in the Delhi High Court against WinZO Games under the Arbitration & Conciliation Act, 1996, regarding the trademark registration of the tagline “Jeeto Har Dinzo.” The advertising agency states that WinZO applied for the trademark before finalizing an agreement for a brand campaign.

Details of the Petition

As reported by Storyboard 18, according to the petition, a Non-Disclosure Agreement (NDA) was signed between Creativeland and WinZO on October 11, 2024, which included an arbitration clause. Creativeland states that after presenting its campaign proposal and related materials, WinZO filed trademark applications for “Jeeto Har Dinzo” without concluding a formal contract.

The petition seeks to prevent WinZO and any third party from using confidential materials, including the tagline and contents of the agency’s First, Second, and Third Pitch Decks. Additionally, Creativeland has requested that WinZO not pursue trademark applications in classes 41 and 35 (bearing nos. 6810754 and 6810753) until the matter is resolved.

Court’s Intervention and Arbitration Appointment

During the proceedings, WinZO’s legal counsel stated that the materials provided in the proposal were not being used. The Delhi High Court suggested that an arbitrator be appointed to address the matter, and both parties agreed.

Justice Manmohan Singh, Former Judge of the Delhi High Court, has been appointed as the arbitrator to review the trademark claims and related concerns. The court noted that since WinZO’s campaign was planned for IPL 2025, set to begin in March, a timely decision is required.

The arbitrator has been asked to treat Creativeland’s petition under Section 9 of the Arbitration & Conciliation Act as an application under Section 17 and provide a decision within five days from the date of the order.

Next Steps

With IPL 2025 approaching, the resolution of this matter will determine whether WinZO can proceed with its campaign using the tagline. Both parties now await the arbitrator’s decision.
