On the comprehensive regulatory framework on betting and gambling, A. D. Singh on 12th March 2025. The Minister of State for Home Affairs(MoS Home), Shri Bandi Sanjay Kumar has replied stating that betting and gambling fall under the jurisdiction of state governments, as per entry 34 in the State List of the Seventh Schedule to the Constitution.
According to a report by Kalinga TV, MoS Home Affairs stated in a written reply to the Rajya Sabha that matters related to betting and gambling are listed under the State List in the Seventh Schedule of the Constitution. He emphasized that state legislatures have the authority to regulate these activities.
Sanjay Kumar’s statement further clarified that “Police” and “Public Order” are also state subjects. This means that state governments and law enforcement agencies are responsible for preventing, detecting, investigating, and prosecuting crimes related to illegal betting and gambling.
The issue was raised in Rajya Sabha under Starred Question No. 143, where the government was questioned about the possibility of a comprehensive regulatory framework for betting and gambling. The query sought clarity on licensing requirements, player protection measures, responsible gambling provisions, and taxation policies.
In response, the Minister of State for Home Affairs, Shri Bandi Sanjay Kumar, reiterated that “Betting and gambling is entry 34 in the State List of the Seventh Schedule to the Constitution.” He explained that under Article 246 and Article 162, the power to legislate on these matters lies with the states.
He further stated, “The States/UTs are primarily responsible for the prevention, detection, investigation and prosecution of crimes including for action on illegal betting and gambling through their Law Enforcement Agencies (LEAs).” The government did not indicate any immediate plans to introduce a centralized law on the matter.
