In the ongoing battle between Winzo and Zupee, Microsoft Corporation has testified before the Delhi High Court, expressing its willingness to provide relevant data without the need for impleadment.
As reported by Storyboard18, WinZO had earlier approached the court, seeking permission to obtain critical information from Microsoft as part of its case against Zupee and associated entities, including Data Empiric and FutureMinds Consulting. The legal dispute started from allegations that Zupee engaged in unauthorized attempts to extract sensitive business information from WinZO, including revenue figures, marketing strategies, and key operational metrics.
According to court documents, Microsoft stated that it is prepared to provide the requested details, including participant information, IP addresses, and other identifiers, provided a court order mandates it. The tech giant also clarified that it does not need to be implemented as a defendant (proposed defendant no. 6) for this purpose. The matter is scheduled for a hearing in the Delhi High Court on February 27.
In response, WinZO indicated that if the required data could be obtained through a court order without involving Microsoft as a party to the case, it might not pursue the impleadment application, subject to further legal instructions. The court will decide on further directions regarding the application in the coming hearings.
Allegations of Data Breach and Unfair Practices
WinZO has alleged that Zupee planned attempts to gain access to confidential business intelligence by contacting its employees and soliciting key internal details. The company claims that Zupee representatives, through Data Empiric and FutureMinds Consulting, engaged in a paid “market research” scheme, where sensitive corporate information was collected under false pretenses.
A key accusation in the case involves the use of Microsoft Teams’ “Guest” feature, which WinZO alleges was exploited by Zupee members to mask their identities while soliciting confidential data. WinZO has reportedly submitted audio recordings and transcripts as evidence, seeking court validation of their claims. Additionally, the company has asserted that Zupee’s actions resulted in interference with its commercial contracts, giving its competitor undue access to confidential information.
Legal Developments and Upcoming Proceedings
The Delhi High Court had issued a notice to Microsoft in December 2024 following WinZO’s request. A subsequent order dated January 29, 2025, confirmed Microsoft’s willingness to cooperate in disclosing participant details linked to the case. The next hearing is set for February 27, where the court is expected to provide further directives on the matter.
The outcome of this case could have significant implications for the online gaming industry, particularly concerning data security and competitive practices. As both companies continue their legal battle, the gaming community awaits further developments with keen interest.
